ICYMI: Bronx Father Exposes ADA Violations and Withheld Evidence in Explosive WABC Interview With Roger Stone

NEW YORK, NY —— Disabled father and advocate Marc Fishman continued calling out systemic misconduct in New York’s justice system after revealing in an interview on The Stone Zone (WABC 770 AM) that exonerating evidence was withheld, disability accommodations denied, and conflicts of interest ignored in a case that led to his 45-day jail sentencing by Westchester DA Susan Cacace. Fishman, a father of four living with traumatic brain injury, hearing loss, and cognitive impairment, says his ordeal began during a court-approved supervised visit with his autistic son in 2018. Despite complying with all legal requirements — including a paid supervisor and disability aide — Fishman was arrested for allegedly violating an unserved order of protection.

“The arresting officer himself said on tape that I had no intent to commit a crime — but that evidence was hidden from the jury,” Fishman said. “They refused me accommodations and ignored federal orders. This isn’t justice — it’s persecution.” 

Crucial police video and audio — obtained only through a federal lawsuit — show the now-terminated officer admitting Fishman committed no crime. That same officer, Lane Schlesinger, had over 40 civilian complaints and a documented pattern of misconduct, yet remained on duty until 2024.

Meanwhile, Attorney General Letitia James’ office investigated police misconduct while defending judges accused of violating Fishman’s ADA rights.

“How can the same Attorney General investigate police while defending judges who broke the law?” Fishman asked. “It shows how deeply the system protects itself.” 

Roger Stonehost of The Stone Zone, called the case “one of the most disturbing miscarriages of justice” he’s encountered.

“Marc Fishman’s story should alarm every parent in New York,” Roger Stone said. “This is not prosecution — it’s persecution. What happened to him shows how easily the system can be weaponized against ordinary people, especially those with disabilities.”
