Introduction

Attorney Virginia Foulkrod, a government-funded lawyer at the Hudson Valley Justice Center (HVJC), is accused of violating federal disability laws and misusing public grant funds while representing Jennifer Solomon—Marc Fishman’s ex-wife—in their ongoing Westchester custody case.

Fishman alleges that Foulkrod and HVJC, a nonprofit that receives over $1 million annually in federal and state grants, discriminated against him as a qualified disabled parent by opposing his ADA-protected communication and access accommodations. Such actions, he argues, violate U.S. Department of Justice regulation 28 CFR § 35, Section 504 of the Rehabilitation Act, and FERPA (the Family Educational Rights and Privacy Act), which protect disabled parents’ access to their children’s educational records.

Dear Hudson Valley Justice Center Board Chair Eric Gordon,

I am writing concerning disability discrimination and utilization of federal funds paid to your nonprofit to advocate against me as a qualified disabled parent.

As a disabled hearing-, vision-, and mobility-impaired parent (with occipital neuralgia, tinnitus, TMJ, and neurostimulator implants), it is illegal to restrict my access to education records for my twin 16-year-old sons, Aidan and Skye Fishman. Under FERPA and Section 504 of the Rehabilitation Act, public schools—including Mamaroneck Schools—cannot withhold records or deny access to disabled parents.

Your attorney Virginia Foulkrod has illegally used federally funded HVJC grant resources to oppose my access to school records and ADA accommodations, including disability-friendly school portals. These acts constitute civil-rights violations under federal funding agreements and DOJ ADA regulations.

I call on your organization to withdraw the proposed custody modification order (FU 131794) and educate your staff to stop discriminating against disabled parents. Please advise how you intend to rectify this and comply with federal civil-rights laws so I can protect my rights and notify appropriate agencies.
