Michele I. Schauer is a judge on the Westchester County Family Court, based at 111 Dr. Martin Luther King Jr. Blvd., White Plains, New York.
She was appointed (or nominated) to the Westchester Family Court bench in about June 2010.
Prior to her election/appointment as a judge, she served as a Court Attorney Referee in the Westchester County Family Court’s Abuse & Neglect / Permanency Planning parts and has worked with the CASA (Court Appointed Special Advocates) program in Westchester.
In Marc Fishman’s litigation, Schauer’s court presided over (or was involved in) the family-court matters that led to orders granting Jennifer Solomon sole legal and residential custody (in a June 2018 order of fact-finding, Westchester Family Court, Michelle I. Schauer, J.).
According to Marc’s pleadings, Judge Schauer allegedly denied him key communication and disability accommodations (e.g., note-taker, transcript, large-print materials) in family-court proceedings, and blocked his access to his children’s records and schools — actions which he contends were discriminatory against him as a disabled parent.
Her court served as the setting for contentious litigation over parental rights, guardianship/access, and educational record access — which Marc argues underscores systemic disability-rights and civil-rights violations in the Westchester Family Court system.
Disabled Father Warns Westchester Court: FERPA and ADA Violations Will Trigger Federal Action
Marc Fishman writes to Judge Schauer defending his parental rights under federal laws ensuring access to his children’s educational records. He highlights ongoing legal violations by opposing counsel, Virginia Foulkrod, and emphasizes the obligation of schools and courts to accommodate disabled parents. Fishman threatens federal action if access is denied.
