Stop the Jailing of a Disabled Father in New York

Marc Fishman’s case is more than a local injustice — it’s a national test of disability rights and judicial integrity. Despite a 2021 ruling by the U.S. Court of Appeals for the Second Circuit confirming his right to real-time transcription and other communication accommodations under the Americans with Disabilities Act (ADA), Westchester County officials have continued to deny him access to justice.

Now, Marc faces a 45-day jail sentence after a flawed prosecution led by a District Attorney’s Office riddled with conflicts of interest and ethical violations. Key evidence — including the New York Attorney General’s findings that the arresting officer engaged in a “pattern of misconduct” — was withheld from his defense.

This petition calls on New York’s leaders and federal authorities to intervene, halt Marc’s incarceration, and open a full investigation into ADA violations, prosecutorial conflicts, and systemic discrimination against disabled litigants in New York’s courts.
